A Victorian man who donated his sperm in the "usual and customary manner" - by having sex with a lesbian - has been found liable to pay child support.

Despite the man [known only as ND] and the lesbian couple agreeing the sperm donor would have no legal rights or financial responsibilities to the child, the Family Court found the man was responsible because the baby was conceived through sex.

This guy wasn’t unknown to the mother:

The court was told the biological parents were a couple in 1997, but within a year the mother, known as BM, left him to begin a lesbian relationship. She underwent a "ceremony of marriage" with her female partner, known as LP, in 1998.

Soon after, the women asked ND - and he agreed - to donate sperm for their child.

The man had sex with BM on three occasions in the presence of her partner.

Wa-hey! But it all too quickly turned into a menage a ripoff:

It is not clear why the mother asked the magistrate's court to order the man be assessed to pay child support.

Probably for money. Yes, that might be it.

I cannot help feeling sorry for this guy but he is still the biggest sucker I've come across this month. When lesbians ask you for sex just say "condoms"...and "baby oil"...

Seriously, while my first reaction was "Get the fuck out of here", on reflection I've decided I agree with the judgement. You can't just father a child and then throw up your hands and say "not my problem". I have no sympathy for the lesbians, but the father's irresponsibility cannot be held against the child.

The flip side is that the father should have the option of joint custody rights. He is the biological parent, and family law should recognise both his rights and responsibilities, except in the case of men who genuinely go through the regulated process of official sperm donation.

Also, while he has family law responsibilities, I suspect he could sue the lesbians for breach of contract and recover his cash out of their assets. But to the extent that they are poor, he will just have to reap what he has sown, so to speak.

If one gets involved with a woman who already has a child, he is finacially responsible when she ends it. Same goes when you don't think it's really your biological child and you want a DNA test. Nurture over nature - okay - i get it...

But if a woman is the other parent it's nature over nurture, say, if any of your semen is involved... okay - clear on that too.

Women never responsible. Man always responsible. okay...

Man standing around, man gets piked. Okay. Understood.

But hey, why stop there! In sweden, there was a case where an anonymous sperm doner was found liable for child support.
